Service Terms and Conditions

By placing an order with Web Intrigue UK, you are confirming that you have read and agree to be bound to the terms and conditions given below.

Definitions

“The client” means the company or individual who is buying a service or services from Web Intrigue UK of Bodelwyddan, Denbighshire, North Wales.

“Web Intrigue” means the internet website development business providing the service or services to the client, fully known as Web Intrigue UK.

“The agreement” means the contract between Web Intrigue and the client to which these conditions apply.

“The order” means the request by the client for a service provided by Web Intrigue.

“Completion of the order” means when the web page(s) or website has been completed and uploaded to a temporary server for the approval of the client.

“Deliverables” means the output of services to be supplied by Web Intrigue to the client under the agreement which will be all software, written materials, and media (such as CDs) agreed in the order.

General

Web Intrigue will carry out work only when an agreement is made by completion of an order form or signing of the quotation form by the client.

Web Intrigue reserves the right to decline orders. In light of the Online Safety Bill 2022, Web Intrigue will only build websites it feels are suitable for viewing by members of the public of all ages. Any orders that Web Intrigue believes would be offensive, or cause harm to certain groups of the general public, or be offensive to any religious groups will be politely declined.

Web Design & Web Development Service

Clients must be over the age of 18 years.

The process of the order is conducted under the terms of the Web Intrigue service guarantee.

A deposit of 25% of the total cost of the order is required with any project before design work is started.

The website, associated graphics and any programming code remain the property of Web Intrigue until all outstanding monies have been paid to Web Intrigue.

Web Intrigue cannot take responsibility for copyright infringements caused by materials provided by the client. Web Intrigue reserves the right to refuse the use of copyrighted materials if the client is unable to supply sufficient proof of granted permission to use such materials

The client must agree to make available to Web Intrigue all materials needed to complete the website as soon as is reasonably possible and within a set deadline.

Web Intrigue will not in anyway use materials provided by the client other than for the sole purpose of content construction (either built into a ‘static’ web page or contained within a database-driven content management system) for the agreed website or websites for that client.

Web Intrigue excludes itself from all and any liability for loss or damage to client’s materials which is out of Web Intrigue’s control.

On completion of the order, the deliverables will be uploaded to a temporary server for the client’s approval. Upon the client’s approval, the final balance of payment is then due. All payments must be by cheque made payable to “Web Intrigue” in pounds sterling. Once the cheque has been cleared, Web Intrigue will then supply the deliverables, i.e. the web page(s) or website will be uploaded to the client’s web hosting service and other materials described in the order will be supplied.

Any web page or complete website designed and developed by Web Intrigue (not the actual website content) is copyright and cannot be reproduced without prior written consent. Any computer scripts or software (unless stated as unique to the order) remain the copyright of Web Intrigue and may only be reproduced following prior written consent.

Domain Name Registration Service and Domain Name Ownership

Domains that are registered through Web Intrigue: By default the domain registrant, who holds the rights of the domain, will be the client of Web Intrigue. As the acting registrar, Web Intrigue is responsible for domain registration renewals, through the third-party hosting and domain registration company (the actual registrar). Web Intrigue will in turn bill the client at an appropriate point in time, either 2 weeks before renewal is due, or when the hosting package renewal is due.

There is the option that if the client does not want the domain authorities to hold their personal or business information, then Web Intrigue can act as domain registrant. In these circumstances, an agreement document is drawn up stating who the domain “owner” actually is, and when next the agreement document is should be reviewed – this date would usually coincide with the domain name registration date.

Website Hosting Service

All customers who have purchased from “web design and web development” service are offered our website hosting service, starting with the first 12 months’ free of charge. Included in this package is technical support relating to this service, including email account maintenance. The website hosting service package is renewalable every 12 months at the charge advertised. A slightly lower charge is offered for websites that are not using the ‘WordPress’ content management system (CMS).

The hosting services are provided by our third party, 20i, based in Mansfield, Nottinghamshire, through a business reseller hosting account we hold with them. 20i have there own terms of use, and must be adhered to by our clients when using this service. Refer to section 14 of the 20i Terms and Conditions.

Clients of our website hosting service will be given a StackCP (Stack Control Panel) account, to gain access to the website files and database, view statistics, and manage email accounts for one or more domains. It is the responsibility of the client to keep the StackCP password secret and to use a ‘strong’ password at all times. More than one StackCP user can be assigned to gain access to a particular StackCP account. Clients must apply for an additional account rather than share a StackCP account.
